Here you will find information on how to make a representation in relation to applications for New Premises Licences, a Variation of an existing Premises Licence or a Provisional Statement made under the Gambling Act 2005.
The following Responsible Authorities are able to make a representation:
- The Licensing Authority
- The Gambling Commission
- The Chief Officer of Police
- Fire and Rescue Authority
- Local Planning Authority
- Pollution - Local Authority
- Safeguarding Children Board
- HM Revenue and Customs
Interested Parties can also make a representation, provided that they fall into one of the following categories:
- A person that lives sufficiently close to the premises to be likely to be affected by the authorised activities
- A person that has business interests that might be affected by the authorised activities, or
- A person who represents people or persons in either of the above two groups
The representation period starts on the day a valid application is received by the Licensing Authority and lasts for 28 consecutive days. During this period a notice will be published in the local newspaper on one single occasion within 10 days of receipt of the application by the Local Authority. A notice also has to be displayed on the premises or in a place where it can be conveniently read by passers by for the 28 day period.
Any representations made to the Licensing Authority must be made in writing and received during the representation period. The Licensing Authority will then determine whether the representation made is relevant.
The only representations made that are likely to be relevant are those that relate to the Gambling Act 2005 objectives, raise issues under the Licensing Authorities Statement of Gambling Policy or the Guidance/Codes of Practice issued by the Gambling Commission.
Representations that have been made anonymously will not be accepted. Any representation that is made will be included in a report to the hearings panel. This report is a public document, and will be circulated to all the parties involved prior to the hearing.
If a petition is received, it will be treated as one representation from the person that has submitted the document, supported by the other signatories. Petitions will not be treated as individual representations from all persons that have signed the document.
A hearing will then be held to determine the outcome of the application.
