What happens if I have been overpaid Housing Benefit?
If you have been overpaid Housing Benefit you will receive information that explains
- the reason for the overpayment
- the period of the overpayment
- the amount of the overpayment
- why it is a recoverable overpayment
- how it is going to be recovered, and who from
- details of your right of appeal
How overpayments are recovered?
If you continue to receive Housing Benefit, a weekly amount can be deducted from your ongoing Benefit entitlement to help repay an overpayment.
If the weekly deduction was, for example, a deduction of £5.00 a week, you would need to pay that shortfall toward your rent.
If the weekly deduction is causing financial difficulty you should Contact the Benefit Recovery team.
The level of recovery can be adjusted if you are experiencing financial difficulties.
You may receive an invoice for an overpayment of Housing Benefit.
Please do not ignore the invoice.
Please contact the Benefit Recovery team to ensure further recovery action is not necessary.
Further recovery action can include :
- Referral to the Department of Works and Pensions for direct deductions from any prescribed benefits that you receive;
- Referral to an external Debt agency;
- Application of a Direct Earnings Attachment if you are in work or,
- Referral to the NCC litigation section for court action
Direct Earnings Attachment
Local Authorities will use this method of recovery to recover overpaid Housing Benefit by direct deductions from a citizen's earnings. This is without a need to apply for a court order.
Not everyone enters into a voluntary repayment arrangement, so, DEA's give the Local Authority the opportunity to recover overpaid benefits from those citizens who are employed.
Notifications are issued to the citizen and the employer to help explain the stages of the process.
Pay an over-payment
If you receive an invoice, you can contact the Benefit Recovery team to set up an arrangement to pay the overpayment.
You can pay in full or by instalments. The invoice has all the available payment options on the back.
Direct Debit - It is very easy to set up a Direct Debit over the telephone. Simply call us on 0115 915 4497.
If you do not want to set up the Direct Debit over the telephone, simply discuss the arrangement with us and then complete a direct debit form and post or email it to us.
