Houses in Multiple Occupation

Nottingham City Council hereby
give notice that in accordance with Paragraph 3(2) of Part Two of the Schedule to the Housing Act 2004
(Commencement No.5 and Transitional Provisions and Savings)(England) Order 2006, the whole of the area
within the City of Nottingham is deemed to be designated as an area subject to additional licensing.
This designation came into force on 6th April 2006.

Any landlord, person managing or tenant within the City should seek
advice from the Public Health Section as to whether their property is affected by this licensing scheme.
Landlords, managers and persons having control of houses in multiple
occupation (HMOs) within the City of Nottingham are informed that controlling or managing an HMO which
ought to be licensed but is not licensed, without a reasonable excuse for doing so, is committing a
criminal offence subject to a maximum fine of £20000. A person will not be guilty of such an offence
if there is an effective application outstanding with Nottingham City Council for the granting of a
licence or a temporary exemption notice.
HMO Licence Fees (21st
March 2007)
The Standard fee is £600.00 per application
for a licence of up to 5 years duration.
There is no multiplier element linked to the size of the building included
in the standard fee and no contingency element. Any extra ordinary / unforeseen costs will be charged
to the applicant on a case by case basis.
The costs associated with carrying out basic fit and proper searches
and management / financial checks are charged only once where multiple applications are made at the
same time or within a 6 month period. The cost element built into the standard
fee for these checks is approximately £60. E.g. if a landlord submits ten applications the first application
would cost £600 and the remaining nine would cost £540 each.
In addition there will be a fee of £11 payable per
habitable room where it is necessary to undertake an inspection in connection with the application.
A charge of £50 will also be made where incomplete applications are made and owners
are contacted to request additional information in connection with their application.
The fees will be reviewed annually to take account of salary, overhead’s,
inflation and other cost increases.
