Nottingham City Council has successfully prosecuted a resident for
noise nuisance at the Nottingham Magistrates Court on 12 May 2008.
Complaints
were made against Ms Carley Drewry of 7 Leiston Gardens, Bestwood, regarding loud amplified music.
The allegations were investigated by Nottingham City Council’s Noise and Pollution Control
Team and following observations made by officers, a noise abatement notice was served on Ms Drewry on
6 November 2007.
Council officers witnessed two contraventions
of the noise abatement notice in person and also obtained digital recordings of 4 other contraventions
over the next 3 months.
On 5 March 2008 the Council’s bailiff executed
a warrant which was granted by Nottingham Magistrates’ Court. They entered 7 Leiston Gardens and
seized 12 items of electrical equipment from Ms Drewry including 1 large TV, 2 portable TVs, 4 HiFis,
an Xbox and a Playstation 2.
The Noise and Pollution Control Team prosecuted
Ms Drewry and she pleaded guilty to all 6 offences.
She was fined £200
and Nottingham City Council was awarded £150 costs. Together with a victim surcharge of £15, she
is liable to pay £365. The Court also made a deprivation order which mean that all the equipment seized
will be retained and disposed of. The equipment will not be returned to Ms Drewry.
Mr S Thorpe, Noise and Pollution Control Team, said: “Nottingham City Council seeks
to resolved noise nuisance problems informally, however where persistent problems occur and the perpetrators
do not take heed of warnings or comply with legal notices then we will take appropriate enforcement
action to deal with the problem.”
