Late Night Levy

The Council has approved the introduction of the Late Night Levy Scheme within the City

The Late Night Levy Scheme will apply to holders of both premises licences and club premises certificates granted by the Council which authorises the supply of alcohol after midnight. It does not apply to premises that only provide regulated entertainment or late night refreshment, without the supply of alcohol.

If you would like to make a payment

An invoice will be issued to you at the same time as your annual licence fee is due.

Exemptions

The Council has decided the following categories of premises should be exempt:

  • Premises providing overnight accommodation
  • Theatre and cinemas
  • Bingo Halls
  • Registered Community Amateur Sports Clubs
  • Certain Community Premises
  • Certain Country Village Pubs
  • Premises which are a member of the BID scheme
  • On New Year's Eve from the end of permitted hours to start of permitted hours on New Year's Day

The Government has set the criteria for the exemptions which are quite specific and are stated in the Late Night Levy Exemptions document below. If you feel you fit into one of the exemption categories, you should advise the Licensing Office as soon as possible.

Can I vary my premises licence so that I do not have to pay the levy

Yes.

You may wish to vary the hours of the authorised sale of alcohol at the premises licence in order to avoid the additional cost of the late night levy. If you do not submit an application to vary your licence then the late night levy charge will apply to you. Do I have to pay the levy if I sell alcohol between midnight and 6am under the authority of a Temporary Events Notice?

No.

What can the levy proceeds be used for

First of all, we will deduct our administrative expenses from the amount received in connection with the levy. Government regulations limit what we can deduct.

The the net amount of levy will be split between Nottinghamshire Police, Crime Commissioner and the Council. We have decided that the split will be 70/30.

Government regulations limit the purposes for which the Council can use its share. It has to be used on activities designed to address crime and disorder, public safety, public nuisance and street cleansing in connection with the supply of alcohol between 00.01 and 06.00. This will be achieved through the establishment of two night time Community Protection Officer posts.
