Temporary Use Notice

Here you will find information on a Temporary Use Notice. This allows premises to be used to provide temporary gambling facilities.

The purpose of this notice is to allow a premise to be used for temporary gambling where no premises licence has been issued under the Gambling Act 2005.  Applicants need to be the holder of an Operating Licence issued by the Gambling Commission prior to making an application to the licensing authority.

The same premises may not have a Temporary Use Notice for a total of more than 21 days in a 12 month period. However, the same premises may be subject to several Temporary Use Notices provided that the total does not exceed 21 days. A Temporary Use Notice may not be given in respect of a vehicle.

The Temporary Use Notice has to be received by the licensing authority not less than three months and one day before the day on which the temporary gambling event will begin.

The Temporary Use Notice will also need to be copied and sent to the following Responsible Authorities:

  • Gambling Commission
  • Police
  • HM Customs and Excise
  • If applicable, any other Licensing Authority

The licensing authority and the other Responsible Authorities listed above are allowed to make objections in relation to the Temporary Use Notice. Any objection must be made within fourteen days of the Temporary Use Notice being received and a counter notice will be issued to the applicant.

A hearing will then take place to determine the Temporary Use Notice application.

If no objections are received, the event is permitted to take place. The licensing authority will endorse and return the Temporary Use Notice to the applicant. The Temporary Use Notice  must be on display at the premises where the event is taking place for the duration.
